1.General Introduction
1.1. Welcome to the Americart website (hereinafter: "the Website"). The Website is operated by American Goods Ltd., whose address is 3 Rabbi Nachman of Breslev Street, Afula (hereinafter: "the Company"), and serves as an online platform for selling food products (hereinafter: "the Products").
1.2. These terms constitute a binding legal agreement between the user of the Website (hereinafter: "the Customer") and the Company. Browsing the Website, using its content, and making purchases through it, constitute your explicit and unconditional agreement to all the terms detailed in these regulations.
1.3. The Customer hereby declares that they have carefully read, understood, and fully agreed to all the provisions of these regulations, and waives any claim, demand, or action against the Company and/or its representatives, except for claims related to a breach of an explicit commitment by the Company under these regulations.
1.4. The Company reserves the right to change the regulations from time to time, at its sole discretion. The binding version of the regulations is the one published on the Website at the time of the action.
1.5. These regulations are drafted in the masculine gender for convenience only and refer, of course, to both genders equally.
1.6. In these regulations and in the Website's activity, business days shall be Sunday through Thursday, excluding Israeli holidays, Memorial Day and Independence Day, and/or days when the economy is not operating as usual, such as days of mourning, days when a state of war/emergency is declared, etc., all at the Company's discretion.
2. Eligibility for Using the Website
2.1. Making a purchase on the Website is permitted only to a Customer who is 18 years of age or older and is legally competent to perform binding actions.
2.2. By browsing and using the Website, the Customer declares and confirms that they meet the legal age requirement for the actions they perform, as well as any other legal criterion required for it.
2.3. Should a purchase be made by a minor (under the age of 18) or by someone not legally competent to perform legal actions without a guardian's approval, the action will be deemed as if it received the legal guardian's approval.
3. Use of Third-Party Services and Limitation of Liability
3.1. For the ongoing and secure operation of the Website, the Company uses services provided by third parties, including, but not limited to, a web hosting and building platform (Wix) and secure credit card processing services (Grow) (hereinafter: "Third-Party Services").
3.2. The Customer is aware and agrees that the use of the Website is also subject to the terms of use and privacy policies of these Third-Party Service providers.
3.3. It is hereby clarified that the Company is not responsible for the quality, availability, security, or functionality of Third-Party Services. The Customer agrees that they will have no claim, demand, or action against 'American Goods Ltd.' for any damage, malfunction, or loss, direct or indirect, caused as a result of the use, reliance, or any other interaction with these Third-Party Services.
4. Products and Prices
4.1. General: The Company offers food products for sale through the Website, with the selection of products being updated from time to time. The Company may change the supply and variety of products on the Website at any time.
4.2. Inventory: The Company makes efforts to update the inventory on the Website in real-time. However, there may be cases where a product that was ordered is out of stock. In such a case, the Company reserves the right, at its sole discretion, to offer the Customer a substitute product or to cancel the charge for the missing product.
4.3. Product Images: The images and descriptions displayed on the Website are for illustrative purposes only, and differences may exist between the image and the product actually supplied.
4.4. Prices: The price displayed next to each product on the Website is its final price and includes Value Added Tax (VAT) as required by law. The Company reserves the right to update the prices of products on the Website at any time, without prior notice. The binding price is the price provided to the Customer upon completion of the ordering process.
5. Purchase and Payment Process
5.1. Payment Methods: Payment on the Website will be made via credit cards approved for processing by the payment processing company with which the Company works.
5.2. Payment Security: The credit card processing procedure on the Website is carried out through a leading and secure external payment provider. The Customer agrees that the use of the external provider's services is subject to that provider's privacy policy and terms of use, and the Company is not responsible for its activities.
5.3. Order Confirmation: Receipt of an order from the Customer does not constitute a final confirmation of its fulfillment by the Company. A final confirmation will be given only when the package is prepared for shipment. The Company reserves the right not to approve an order or to cancel items from it, including, among other things, lack of inventory or any other relevant consideration, at its sole discretion. In the event of an item cancellation, the Customer will be credited accordingly.
6. Supply and Deliveries
6.1. Product delivery is conducted on business days (1.6) and is subject to a shipping fee according to the region and shipping method. A free self-pickup option will not be available. Products will be delivered only to addresses located within the following service areas: Jerusalem, Mevaseret Zion, and Beit Shemesh. The Company may update the service areas from time to time.
6.2. Deliveries will be made by a courier of the Company or one acting on its behalf to the address specified in the order within 2 business days. The shipping cost will be 30 ILS. Orders placed on a business day (Sunday-Thursday) by 12:00 PM will be delivered by 2:00 AM the following night (i.e., early morning of the next day). An order received after this time will be delivered on the next business day.
6.3. Notwithstanding the foregoing, the Company will grant free shipping on purchases over 200 ILS, and a discounted price for delivery to students at selected distribution points on the premises of designated academic institutions, subject to the Company’s discretion.
6.4. The website shall not bear liability for any delay and/or lateness in delivery performed by a third party due to force majeure, strikes, lockouts, or the customer’s failure to respond for delivery coordination.
6.6. Customer's absence from the delivery address: In the event that the customer is not present at the address upon the courier's arrival, the customer agrees and authorizes the Company or a courier on its behalf to leave the package near the entrance door of the address provided by the customer. From the moment the package is left, the sole responsibility for it, including in the event of theft, loss, or damage, shall lie with the customer alone.
6.7. It is clarified that the Company reserves the right to perform the delivery service itself or through an external provider, at its sole discretion.
7. Cancellation and Product Return Policy
7.1. Transaction Cancellation by the Customer: A customer may cancel the transaction in accordance with and subject to the provisions of the Consumer Protection Law, 5741-1981. If the order has not yet been packed and shipped, the Customer will be credited for the full transaction amount. If the order has already been packed and transferred for delivery, the Company shall be entitled to deduct the full delivery fee (ILS 35) from the refund amount, even if the original order qualified for free delivery.
7.2. Product Returns: A product can be returned within 14 days of its receipt, provided that the product is in its original packaging, has not been opened or used in any way, and is within its expiration date.
To initiate a return, the customer must send a written request via WhatsApp message to +972-50-281-2293. The Company will respond within 2 business days.
7.3. Non-Returnable Products: In accordance with the law, "perishable goods" (food products and products that may spoil, are close to their expiration date, or have expired) cannot be returned, in accordance with the law and at the discretion of the Company.
7.4. Cost of Product Return: In the case of a product return (other than for a defective product), the Customer shall bear the pickup and delivery cost of ILS 35, which will be deducted from the refund amount.
7.5. Transaction Cancellation by the Company: The Company may cancel any transaction, in whole or in part, at its sole discretion, including in cases of an inventory error, a pricing error, or if suspicion of illegal activity arises.
8. Liability, Privacy, and Intellectual Property
8.1. Product Liability: The liability for the nature of the products, their quality, and their expiration date applies to the manufacturers and/or importers only, in accordance with the details appearing on the product packaging. The Company acts solely as an intermediary.
8.2. General Limitation of Liability: The Company shall not bear any liability for any direct or indirect damage caused to the Customer or any third party as a result of the use of the Website, the services, and the products, or reliance on the information appearing on it.
8.3. Privacy Policy
8.4. Intellectual Property: All materials appearing on the Website, including texts, graphics, images, logos, and trademarks, are the exclusive property of the Company and/or third parties. One may not copy, reproduce, distribute, or make any commercial use of this content in any form without obtaining explicit written permission from the Company.
9. Promotions
9.1. The Company may offer promotions, benefits, and discounts on the Website. These promotions will be exclusive to the Website, unless explicitly stated otherwise. The Company may terminate any promotion at any time and at its sole discretion.
10. Governing Law and Jurisdiction
10.1. These regulations and all that arises from them shall be governed exclusively by the laws of the State of Israel.
10.2. The exclusive jurisdiction in any dispute or disagreement concerning these regulations or the use of the Website shall be vested exclusively in the competent courts in the Jerusalem District.
